If you have papers that need to be served to someone who isn’t typically available for much of the day, you might be wondering how they are going to get served. It is important to remember that process servers do not work bankers’ hours. You can have papers served in the evenings or on the weekends, as well as other times that someone might be found at home.
Evenings
There are no rules about how late in the day a process server can serve papers. Most process servers will not attempt to serve papers after about 8 P.M. unless there are extenuating circumstances. Sometimes people are more likely to be found at home in the evenings if they work full time, and this may be a better option than serving them at work.
Weekends
Process servers don’t just work Monday through Friday. Most process servers are well aware that they will have papers to serve on the weekends because that is when working people are most often found at home. Most process servers will try to serve papers on Saturday, but some will work Sundays as well. There is no legal reason not to have someone served on Sunday.
Holidays
Whether it is a religious observance or a national one, holidays are not exempt from process service. In fact, process servers can serve papers on any day of the year, including Christmas. Most people will not serve papers during the major holidays like Christmas and Easter because they don’t want to be the bearer of bad news while people are with their families. But if it is the only time someone can be served, some process servers will go ahead and work on these holidays.
