How to Serve Papers Safely

Prudent process servers always have safety on their minds. Visiting unfamiliar neighborhoods to track down complete strangers comes with risks that should be mitigated to the fullest extent possible. Stay safe while serving process with these tips and tricks:

Come prepared

The old adage is true for process servers: preparation is the key to success. Gather as much information about the target as you can before attempting service. Some key items to search for include:

  • Demographic information
  • A photograph
  • Map of target location and intended route
  • Street view of the target area
  • History of violence, drug or alcohol abuse
  • Public records
  • Recent arrests/pending charges

Time it right

Targets are less likely to react with violence if they are by themselves or at work. Always attempt service when you believe the target may be alone, if possible. If serving a target at work, notify their employer first for approval. Also avoid service when a target is with their children, especially processes related to divorces or domestic disputes.

Watch your tone

Be polite to the target and chances are, the target will be polite to you. If you approach the target with a demanding, condescending, or aggressive tone, there is a greater chance there will be problems.

Use positive body language

Just like with tone of voice, aggressive or intimidating body language will get you nowhere while serving process. Avoid putting your hands on your hips, crossing your arms, or pointing fingers. Instead, opt for a casual approach with relaxed shoulders, arms down by your sides, and a smile.

Do not offer information or advice

It’s not unusual for targets to have many questions about the papers they are receiving. Politely express that you know nothing about the case itself, but are just the messenger.
