Volusia County handles appointments of process servers differently than most Florida counties. Getting appointed as a private process server (also called a special process server) in Volusia County begins with filing a Proposed Order for Appointment of Process Server with the Clerk of Court. This can be efiled for more convenience. A judge will then review the proposed order along with the credentials of the process server up for an appointment. If the judge is satisfied that the process server meets basic requirements, they will approve the process server to serve for that one particular case only. A new proposed order must be filed for each case.
At the most fundamental level, the judge will expect the process server in question to:
- Be 18 years of age or older
- Be legally competent
- Not have any connection, personal or professional, with the case for which they are seeking an appointment
- Have a basic level of knowledge of process server laws and regulations
- Demonstrate good character
The judge may also deny any process server that does not reside in Florida or that does not have a surety bond posted for liability coverage.
