Why Landlords Should Use Private Process Servers

If you are not new to being a landlord or property manager, you are probably well aware that not all parts of the eviction process have to be handled by a process server, but there are some very good reasons to use a private process server for the entire eviction process. 

Three-Day and Seven-Day Notices

Before you can file an eviction with the courts, you have to give your tenants notice that you plan to do so. If a tenant has not paid their rent, you can give them a three-day notice. If the tenant has violated the lease in some other way, a seven-day notice gives them an opportunity to correct the problem before an eviction is filed.

Neither of these notices needs to be served by a process server. In fact, the courts do not require any proof at all that these notices were delivered beyond the word of the landlord. But if a tenant insists that they never received the three-day or seven-day notice, it could delay your eviction proceeding. 

Posting Notices Before Filing

There are a lot of advantages to having a private process server deliver or post your eviction notices for you. First, these private process servers are bonded and registered with the courts, which means that they are not likely to be disputed in a hearing if the tenant claims they did not receive the notice.

The process server also has more time to go around to your properties than you might have. If you have a lot of tenants who need to be evicted or if you work a full time job and manage properties as a side business, you probably don’t have the time to drive all over town posting notices.
